It never hurts to be proactive when choosing your legal team. At the very least, I’d recommend connecting with an attorney before any of the following occurs: launching a course, a rebrand, or before you receive a contract from a brand you’re negotiating with (of course this list isn’t exhaustive). If this sounds like you, I’d recommend connecting with an attorney to see if the vibes are right before those deadlines or launch dates are around the corner. You want to give yourself ample time to shop around and decide who you want to trust with advising your creative business. While some things “just happen” and there’s no way of forecasting the unexpected, if you do have the luxury of time, use it to your advantage to find an attorney that is the right fit for you. It’s better to make that determination sooner without the added pressure of resolving something that needed resolving yesterday.
No, I’m usually looped into brand deals once you and the brand (or agency) have preliminarily negotiated a rate for a campaign and the brand provides a contract for your review. That’s where I come in– I take a look at what was negotiated and the contract to make sure you have a contract that accurately reflects that and is equitable in terms of legal exposure.
Although I do use my expertise to negotiate more money (in some cases), equitable terms, etc., this is different from having an agent or manager because I play no part in pitching brands, strategy/positioning yourself to eventually work with dream brands, and I do not take a cut from what brands pay you for your work. My flat fee service takes that potential bias out of the equation so we can focus on getting you a contract that is fair (or as close to it as we can).
